By creating an account or using Agentype ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms form a binding agreement between you and KB AI LLC, a Wyoming limited liability company ("Agentype", "we", "our", or "us").
Agentype is a SaaS platform for real estate professionals. It provides tools for lead management, AI-assisted follow-up email drafting and sending, listing copy generation, and property viewing scheduling through integration with Google Gmail and Google Calendar.
You agree not to:
The Service integrates with Google Gmail and Google Calendar via OAuth 2.0. By connecting your Google account, you authorize us to send emails and read calendar events as described in our Privacy Policy. You may revoke this access at any time through your Google Account settings. We are not affiliated with Google LLC.
You retain ownership of all data you upload or create within the Service (leads, listings, notes, etc.). By using the Service, you grant us a limited license to process your data solely to provide the Service, including sending relevant data to third-party AI providers to generate content on your behalf as described in our Privacy Policy.
Upon account deletion, your data will be permanently removed from our systems within 30 days.
The Service uses third-party AI services (currently Google Gemini) to generate email drafts, listing descriptions, viewing invitations, and lead-listing matching. When you use these features, relevant data from your account (lead names, emails, notes, listing details) is sent to the AI provider for processing.
You are solely responsible for reviewing, editing, and approving any AI-generated content before it is sent or published. We make no guarantees about the accuracy, tone, or appropriateness of AI-generated content for your specific use case.
The Service offers an optional AI-powered SMS engagement feature that sends automated text messages to your leads on your behalf. By enabling this feature, you agree to the following:
The Service, including its design, code, and branding, is owned by KB AI LLC and protected by intellectual property laws. Nothing in these Terms grants you any ownership rights in the Service.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses. Your use of the Service is at your own risk.
To the maximum extent permitted by law, Agentype shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including loss of profits, data, or business opportunities. Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.
We may suspend or terminate your account if you violate these Terms. You may terminate your account at any time by contacting support. Upon termination, your right to use the Service ceases immediately.
We may update these Terms from time to time. We will notify you of material changes by email or via a notice within the application at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Wyoming.
You agree to indemnify and hold harmless KB AI LLC and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or any content you send through the Service (including emails sent to your leads via the platform).
Any dispute arising out of or relating to these Terms or the Service shall first be resolved through good-faith negotiation between the parties for a period of thirty (30) days following written notice of the dispute.
If the dispute is not resolved through negotiation, it shall be settled by binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. The arbitration shall take place in Sheridan, Wyoming, and the arbitrator's decision shall be final and binding. Judgment on the award may be entered in any court of competent jurisdiction.
You agree that any arbitration or proceeding shall be conducted on an individual basis and not as a class action, class arbitration, or representative proceeding. You waive any right to participate in a class action lawsuit or class-wide arbitration against KB AI LLC.
Neither party shall be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond the reasonable control of that party, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials. The affected party shall give prompt notice to the other party and shall use commercially reasonable efforts to mitigate the effects of the event.
